Terms of Service

These Terms of Service ("Terms") govern your use of the Stony Valley Business Services LLC ("Company," "we," "our") photo conversion web application (the "Service"). By creating an account, providing payment information, or otherwise using the Service, you agree to these Terms.

1. Eligibility

You must be at least 18 years old and capable of entering into a binding agreement under the laws of Texas and the United States.

2. Free Trial & Payments

Users may convert up to three (3) photos for free, but must provide a valid credit card for identity verification.

After the free trial, continued use requires either:

• A subscription plan, or
• A prepaid conversion package.

By providing payment information, you authorize us to charge your card for fees according to your chosen plan.

3. Subscription & Credit Management

Subscription Plans:

• Monthly subscription plans provide a fixed number of conversions each billing period
• Conversion credits reset at the beginning of each billing cycle and do not carry over to subsequent months
• Unused conversions from the current billing period expire when the new billing period begins
• If subscription payment fails, becomes past due, or is cancelled, all remaining credits are immediately forfeited and access to conversions is suspended

One-Time Packages:

• Prepaid conversion packages do not expire and remain available until used
• Package credits are consumed before subscription credits when both are available
• Refunds for unused package credits are not provided except as required by law

Payment Terms:

• Subscription fees are charged automatically on your billing date
• Failed payments result in immediate service suspension and credit forfeiture
• Account reactivation after payment failure requires settling outstanding balances
• We reserve the right to change pricing with 30 days advance notice to active subscribers

Support Limitations:

• Technical support is provided on a best-effort basis during normal business hours
• Support does not include assistance with third-party software, custom integrations, or bulk processing requests
• Refunds are limited to service credits or billing adjustments at our sole discretion

4. Fair Use of Service

You agree to use the Service only for its intended purpose: converting HEIF files into JPG or PNG formats.

You agree that you will not:

• Use the Service to store or distribute unlawful, harmful, or copyrighted material without authorization.
• Attempt to overload, disrupt, bypass, or misuse the Service, including through bots, scripts, or automated bulk use.
• Resell or redistribute the Service or its outputs without our written permission.
• Attempt to reverse engineer, copy, or clone the Service.
• Circumvent payment requirements, subscription limits, or trial restrictions.

We reserve the right to limit, suspend, or terminate accounts that violate this Fair Use policy.

5. Intellectual Property

All rights, title, and interest in the Service, software, and branding belong to Stony Valley Business Services LLC. You retain ownership of the photos you upload and the converted files you download.

6. Disclaimer of Warranties

The Service is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, including fitness for a particular purpose or uninterrupted availability.

7. Limitation of Liability

To the maximum extent allowed by law:

• Stony Valley Business Services LLC is not liable for lost profits, lost data, or any indirect or consequential damages.
• Our total liability for any claim related to your use of the Service shall not exceed the amount you paid us in the last 30 days.

8. Privacy & Data

We process uploaded photos only for conversion. Files may be temporarily stored to complete processing but are not retained longer than necessary. Please review our Privacy Policy for more details.

9. Termination

We may suspend or terminate your account at our discretion if you violate these Terms or misuse the Service.

10. Governing Law

These Terms are governed by and construed under the laws of the State of Texas, without regard to conflict of law rules.

11. Changes to Terms

We may update these Terms from time to time. If changes are material, we will provide notice (e.g., on the website or via email). Continued use of the Service after changes means you accept the updated Terms.
